Trailer co allowed scissor lift fatally close to HGV route

An SPR employee of the defendant was operating a scissor-lift on 23 January 2015 when the mobile platform was hit by a heavy goods vehicle, pitching the employee from the lift basket 1.5 m on to a roadway.
In a report on the inquest into the 67-year-old worker's death the Ipswich Star said the employee was changing company signs at the entrance to SPR's main Felixstowe site, near the roadway, when the scissor lift was clipped by a 12 m curtain-sided trailer, tipping it over. The report said the employee was airlifted to Addenbrooke's Hospital in Cambridge but died two days later.
Ipswich Crown Court heard that the Health and Safety Executive's (HSE) investigation found that SPR failed to plan and organise the scissor lift's safe operation. The work should have been carried out away from the area trafficked by other vehicles or outside the hours when they were crossing the site.
SPR Trailer Services of 5 Walton Avenue, Felixstowe, pleaded guilty to breaching s 2(1) of the Health and Safety at Work Act.
Speaking after the case, HSE principal inspector Norman Macritchie said: "The company did not undertake the simple safety measure of segregating those working at height from adjacent workplace transport operations, in line with widely available industry guidance."
A Health and Safety Executive (HSE) investigation found that the worker, who was employed as a driver by WK West, was asked to work in the firm’s factory on 3 October 2016 after he had finished his driving duties for the day. The superviser had set up a circular saw and demonstrated the task of pushing stacked cardboard sheets through it. No push stick or jig was used to push the cardboard through the blade. Once the demonstration was complete, the driver was left unsupervised to continue the work.
The committee, a monitoring body of the 47-nation Council of Europe, ruled on 24 January that a change in UK law in 2015 which removed certain self-employed work from the HSW Act, breached the UK’s international obligations.Although the committee recognised that only those in relatively less risky work were not now covered by health and safety regulations, it added that the UK was failing to live up to its commitments in the charter.
National standards bodies (NSBs) voted on the final draft international standard (FDIS) in a ballot that ended on 25 January. It was approved by 93% of them, well above the 75% required for adoption.The International Organization for Standardization (ISO) is currently considering comments for correction from several of the NSBs.News of the publication date follows a long and complex development process. The first draft was published in July 2014, however it received only 42 votes of approval during a May 2016 ballot and was redrafted.
The group is seeking evidence from interested stakeholders until 2 March 2018, after which date it will consider the evidence and produce a report with recommendations on how to reduce the frequency of such accidents. The APPG, which was formed in October 2017, is chaired by Glasgow Central MP Alison Thewliss and sponsored by the Prefabricated Access Suppliers’ and Manufacturers’ Association (PASMA) and Access Industry Forum (AIF).
The accident happened at Mac Skip Hire’s site in Hinckley, Leicestershire, on 4 November 2015. Leicester Magistrates’ Court was told that the employee was trying to remove overhanging waste from a moving shovel loader when she was crushed between it and her lorry. The Health and Safety Executive’s (HSE) investigation found the company had failed to implement systems and site rules for loading operations. It was served an improvement notice to ensure pedestrians and vehicles could circulate safely. This was complied with in February 2016.
The near-miss happened on 22 June 2017 on a steam locomotive from Totnes (Riverside) to Buckfastleigh. The railway is owned and operated by the South Devon Railway Trust, trading as South Devon Railway (SDR). The train was travelling at about 32 km/h when the three-year-old and his mother were in a toilet cubicle at the end of carriage 4805.
