The case follows an incident in March 2017 when the 77-year-old man died falling from his mobility scooter due to a damaged footpath near the Papatoetoe housing development in South Auckland.
An investigation by the New Zealand health and safety regulator WorkSafe found that Shannon Thomson Concrete Pumps had failed to work with other companies on site to identify the damaged path as a risk. The company was found guilty at Manukau District Court under ss 36(2), 48(1) and (2)(c) of the Health and Safety at Work Act 2015.
Following sentencing WorkSafe chief investigator Hayden Mander said Shannon Thomson had both obstructed the investigation and failed to turn up in court.
He added: "Shannon Thomson Concrete Pumps's total lack of regard for the family and the company's role in the man's death is reflected in this massive fine. There was no deduction from the starting point of $500,000 as the judge did not find that there were any applicable mitigating factors."
