Baldwins Crane Hire to appeal against HGV licence ban

Up to 18 drivers altered records to show they had taken rest breaks, when they had not.

Kevin Rooney, traffic commissioner for the north east and responsible for the licensing and regulation of HGV operators, said: "The falsification of records to make it appear that drivers had taken appropriate rest goes absolutely to the heart of road safety. In the case of this operator, five out of seven drivers investigated in 2014 were found to be so offending. A follow-up investigation in 2015 found the offending, if anything, had worsened with 18 drivers found to be offending.

"This was at a time when the company had been under the DVSA [Driver and Vehicle Standards Agency] spotlight as well as been subject to a Health and Safety Executive investigation in relation to the manslaughter of one of its drivers."

Baldwins Crane Hire was found guilty of corporate manslaughter and fined £700,000 in December 2015 after employee Lindsay Easton was fatally injured when the crane he was driving suffered a brake failure and crashed.

Rooney added: "I do not know if my decision will mean the end of Baldwins Crane Hire, but I make my judgement on proportionality on the assumption that it will. The failures are so significant and deep-rooted and inspired by the very top of the business that I find it entirely appropriate that this license be revoked."

From 10 September, company founder and executive chairman Richard Baldwin will be prohibited from applying for or holding a goods vehicle licence in any traffic area for a year, while his son, Wayne Baldwin, will be banned from doing so for five years. Operations director Andrew Skelton will be disqualified for two years and Lorraine Baldwin faces an indefinite ban.

While the ban applies to Baldwins Crane Hire's HGV fleet, it does not impact on the company's mobile cranes, of which it has more than 80.

In a statement posted on the company's website yesterday, Richard Baldwin said: "For the sake of clarification, this disqualification only relates to the individuals being directors or senior managers in a company that holds an operator's licence (that is to say a company carrying out haulage activities, whether for hire or reward or for use in connection with the company's own business).

"The disqualification does not prevent them being a director or senior manager in any other company -- for example the crane hire company. The disqualifications are, in any event, to be appealed along with the decision to revoke the company's operator's licence."

The sentencing guidelines have elevated penalties for OSH regulatory breaches and corporate manslaughter offences. Since their introduction on 1 February this year, there have been as many £1m-plus penalties as there were in the previous 20 years.  In May, one of the group’s divisions, Balfour Beatty Utility Solutions, was fined £2.6m after an unshored trench collapsed on a worker, fatally crushing him.

 Builder neglected timber frame fire risk

The HSE launched an investigation on 27 July after it carried out an unannounced inspection of J G Hale Construction’s site in the town of Blaenavon. It found the company did not properly plan and manage its site and there were no control measures in place to prevent a fire starting and spreading.

 *UPDATE* Builder allowed blow torches on timber-frame project

Tuesday 16th August 2016
South Wales-based J G Hale Construction was building 54 timber-framed houses and flats on the site of a former primary school in the town of Blaenavon. Work began on 24 October 2014 and was due to finish in January this year. The Health and Safety Executive (HSE) inspected the site on 27 July 2015, and found fire safety failings and a failure to control the risk of pedestrian workers being hit by construction vehicles, including a large materials handler, a dump truck, tracked excavators and delivery lorries.

 OSHCR launches job noticeboard

Wednesday 3rd August 2016
Businesses who are registered with the service can use the noticeboard function to advertise their projects, for which OSCHR consultants would then register their interest. Details of the job, such as the role description, location, timeframes and contact details, can be listed.The noticeboard is also available to OSHCR consultants who need to recruit fellow health and safety professionals for projects.

 Bulgarian co let workers risk 11 m fall

A member of the public complained to Walltopia, which is based in Letnitsa, Bulgaria, that its employees were working on a pallet balanced on a telehandler’s forks during construction of a high ropes adventure course at Markeaton Park, Derby. The company promised to stop the unsafe practices, but failed to do so. The member of the public reported the issue to the Health and Safety Executive (HSE), which found employees working on a section of open-edged roof 11 m off the ground. The workers climbed on to the roof from the basket of a cherry picker.

 Security guard ‘left to fend for himself’ on sub-zero construction site

Javaid Iqbal, 29, was working for London firm KK Security Services on a construction site in Leigh, Wigan. Veritas Security (Southern), of Southampton, subcontracted out the job to KK Security, though Veritas’s contract specified it could not subcontract the work.In the early hours of 6 December 2014, the sub-zero temperatures caused the site’s electricity generator to fail. Iqbal could not restart the generator and in an effort to keep warm he lit barbecue coals in a wheelbarrow, which he placed in a 6 m steel container used as the site office.
